Miller Auctions, LLC Terms and Conditions

  • TERMS OF SALE:  By registering for an auction, the bidder has entered a contract bound by the Terms and Conditions of the Sale.  These terms are subject to change by verbal announcement on sale day or by posted notice.  Whether or not you have read or understand any of the terms, participation binds agreement with the following terms. 

  • CONDITIONS:   BUYER REGISTERATION:  Current Driver’s License or Photo ID and Credit Card.

  • NO BUYERS PREMIUM. CASH, VISA, MASTERCARD, DISCOVER, AMEX, WIRE TRANSFERS + Fees(3.5%CC)(30.00wire).  Checks may be accepted by established buyers in good standing with credit card on file,or bank confirmation letterReturn check fee is $30.00. Payment must be made prior to loading merchandise and/or leaving Auction site. Payment is expected to be made immediately following the close of Auction on sale day or scheduled pick-up day for absentee bidders.  By registering and receiving a bid number either by internet, phone or in person means Terms & conditions are accepted and any purchases are subjected and authorized to be paid by credit card given for one time use or on profile. 

  • ABSENTEE BIDS, credit card or cash is required to secure bid. Bid deadline is 30 minutes prior to auction start time, or day before for on-site and/or on-line bidders. Note: look for postings for any changes in times for specific auctions.  Absentee bids placed through our website will be charged to the credit card entered when notified of your win.  If you wish to pay by another method, please let us know at the time of notice. 

  • BUYERS RISK: at the fall of the hammer; you are responsible for your purchases with all faults and mis-descriptions. All items sold “AS IS, WHERE IS, with all faults.  Neither we nor the consignor, make any guarantees, warranties, or representation expressed or implied, related to the property or otherwise. No statement anywhere whether oral or written, shall be deemed such a guarantee, warranty, or representation.  It is the buyer’s responsibility of potential buyer to inspect the property before bidding to determine its condition, size and whether or not it has been restored to their satisfaction. On-Line bidders are encouraged to contact us through the website if additional information is needed.   Due to age and use of some items we specialize in, all items are sold for display purposes, not functionality.  If electrical, mechanical, or other working parts are found dysfunctional, even if working at time of sale, we are not liable.  Security for purchases is the responsibility of the Buyer and begins immediately upon the sale of each lot. Removals are at the expense, liability, and risk of the Buyer. 

  • PHONE BIDDING-Requests for phone bids must be received at least (3) days prior to auction date.  We will make every attempt to accommodate those who wish to participate.  Place request though website contact page. SHIPPING:  FOB. 

  • BIDDING:   The auctioneer reserves the right to determine the highest bidder and to reopen the bidding of a disputed lot.  Floor bids take precedence over internet and absentee bids.  Miller Auctions is not responsible for any bid errors or omissions.  Also, have no liability to any bidder for any technical or other failure associated with the internet, absentee or phone bidding.  Absentee bids are taken during previews or on-line bidding platform.  See notices and instructions on platform.   • ABSENTEE BIDDING/ON-LINE BIDDING:  Absentee bid may be left in person during previews giving a MAX bid to compete with bidders at live auction.  This amount is considered a budget for that item and if bidding does not reach the MAX amount the absentee bidder win at hammer (lower) price.  Bids received on bidding platform will NOT be winning bids but be brought to the live auction to compete with floor bidders. We encourage any inquiries to aid the satisfaction of an item. There are no returns.   

  • BID INCREMENTS  Bid increments listed are a general guideline for ON-LINE auctions.  Actual increments are at the auctioneer’s discretion.  If a lot does not receive a bid or one 25% of the low estimate, the lot may be passed by the auctioneer.

    • ($0- $100     $5.00)     ( $100-$500      $10.00)    ($500-$2000     $100.00)       ( $2000-$5000   $250.00)   ($5000.00 + Auctioneers’ discretion)

  • SALES TAX  will be collected from buyers unless appropriate permits are on file with Miller Auctions. 

  • ITEMS NOT PICKED UP THE DAY OF SALE must be paid for by the end of sale day.  Times and dates will be posted for the next day open for pickups including Absentee and On-line bidders. ANY merchandise left after the sale and pickup day, will be considered Abandoned unless prearrangements have been made.  Special arrangements are subject to a $25.00 fee.  If after considerable time has lapsed and pickup attempts have failed, the Auction House reserves the right to remove, trash, and /or resell to defray any handling expense in connection with said merchandise.  GENERAL INFORMATION-Miller Auctions, LLC, herein after referred to as the Auctioneer, has the right to remove disruptive attendees who impede the preview or auction.  The Auctioneer reserves the right to reject any bid at his discretion, Reserves the right to add to or withdraw from the auction any items listed or not listed, to group individual lots into larger lots, to subdivide lots into smaller lots, or to sell all lots in bulk when it is in the best interest of the Seller. This Auction company makes every effort to describe items correctly HOWEVER no warranty is given with any lot, and no sale is invalid or voidable by reason of any fault in any lot or by reason of any lot being incorrectly described in the catalogue or otherwise, and no compensation may be paid for any such fault or error of description; there are no guarantees, and all items are sold as is, where is with no guarantees.  The Buyer must ascertain the validity of any description given for an item prior to his purchase of that item. Changes to, or additional terms and conditions, or deletions may be announced by the Auctioneer before the course of the auction. The Buyer is responsible for inspecting thoroughly the merchandise and satisfied himself/herself as to its condition and value and to bid based upon that judgment solely. The Auctioneer is acting as Agent for the Seller and all representations made by Auctioneer are made on behalf of the Seller. The Auctioneer is not responsible for the acts or representations of the Seller. Any action or recourse will be directed to the Seller and not to the Auctioneer. All persons attending preparation, sale or removal of merchandise assume all risks of damage or loss to person, property, and specifically release the Auctioneer formal liability, therefore. The Auctioneer shall not be liable by reason of any defect in or condition of the merchandiser premises or auction property on which the sale is held.  Announcements made sale day takes precedence. Royce W. Miller is licensed and regulated by the Texas Department of licensing and regulation and is covered by the recovery fund administered by the department.
